INFORMATION TEXT ON THE PROTECTION OF PERSONAL DATA

In accordance with the Personal Data Protection Law No. 6698 (“Law”) and its secondary legislation, the Information Text on the Protection of Personal Data (“information text”) has been prepared by Robokobi Bilişim A.Ş. (“Robokobi”) to inform individuals whose personal data is processed in the capacity of data controller. As Robokobi, we show utmost sensitivity within the framework of existing legislation and universal values to ensure the security of personal data.

The information text is not applicable in cases where we process personal data on behalf of our users or in the role of a service provider, including situations where we offer various products and services to our users. In cases where we process personal data in the role of a data processor or service provider, it is necessary to contact the relevant data controller.

1. Your Processed Personal Data and Processing Purposes

Your personal data processed by Robokobi falls into the categories of “Identity Information, Contact Information, Transaction Security Information, Customer Transaction Information, Location Information, Personnel Information, Legal Transaction Information, Physical Space Security Information, Risk Management Information, Financial Information, Professional Experience Information, Visual and Audio Records.”

Your personal data is collected and processed in accordance with the general principles specified in Article 4 titled “General Principles” of the Law and, if your explicit consent is present, in accordance with the conditions specified in the first paragraph of Article 5 titled “Conditions for Processing Personal Data” of the Law, or under the conditions specified in the second paragraph of the same article ((a) performance of a contract; (b) fulfillment of a legal obligation; (c) necessity for the establishment, use, or protection of a right; (d) legitimate interest; (e) publicized by the data subject; (f) necessity for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject).

  • Reviewing compliance with applicable terms of use: Your Personal Data is processed based on the legal reason for the establishment and performance of the contract (KVKK 5/2-(c)) to verify that you are an authorized user and to review compliance with the applicable terms of use in the contract of our customer or user.
  • Fulfilling legal obligations: Your Personal Data is processed based on the legal reason for fulfilling legal obligations and the necessity for the establishment, use, or protection of a right (KVKK 5/2(ç) and (e)) to cooperate with public and state institutions, courts, or regulatory and supervisory authorities to the extent required or necessary to protect our rights.
  • Handling communication and user support requests: When you request user support by filling out forms such as “Try Robokobi” or other website forms, or via phone or email, your personal data is processed based on the legal reason for the establishment and performance of the contract (KVKK 5/2-(c)) to fulfill your requests and communicate with you.
  • Improving and enhancing our website and services: Your Personal Data is processed based on Robokobi's legitimate interest (KVKK 5/2-(f)) to analyze trends and monitor your use and interactions with our website and services, to improve and enhance our website and services.
  • Providing and enhancing the security of our website and services: Your personal data is processed based on Robokobi's legitimate interest (KVKK 5/2-(f)) to ensure and enhance the security of services, the website, systems, and applications by monitoring the use of our websites and services, verifying accounts and activity, investigating suspicious activity, and enforcing our policies as necessary.
  • Managing user records: Your personal data is processed based on the legal reason for the establishment and performance of the contract (KVKK 5/2-(c)) to manage your user account to fulfill our contract with you according to the applicable service terms.
  • Performance of the contract: Your Personal Data is processed based on the legal reason for the establishment and performance of the contract (KVKK 5/2-(c)) to fulfill our contract with you or your employer (e.g., when you are an authorized user of our products and services or work for a service provider or supplier).
  • Managing payments: Your financial information and the personal data contained in this information are processed based on the legal reason for the establishment and performance of the contract (KVKK 5/2-(c)) to verify this information, complete transactions, and fulfill our contract with you.
  • Sending commercial electronic messages: With your consent, your personal data is processed based on your explicit consent (KVKK 5/1) to send you marketing information, product recommendations, and other non-transactional communications (e.g., marketing newsletters, telemarketing calls).

2. Method and Legal Reason for Collecting Your Personal Data

Your personal data is collected;

  • When you indicate interest in receiving additional information about our services (e.g., when you request user support (Try Robokobi); use our “Contact Us” or similar features, or sign up to receive newsletters);
  • When you visit our site or make purchases through our site;
  • When you use our products and services and request technical support from us regarding them;
  • When you visit our offices or communicate with us via email, phone call, or fax, among others;

in cases where you contact us and we contact you, either fully or partially automatically or as part of any data recording system, through non-automated means.

3. Transfer of Your Personal Data

Your personal data, as specified above, is transferred by Robokobi to third-party companies located abroad, from which we receive necessary services for the storage of your data on servers, sending emails to you, and providing application services, in accordance with the conditions for transfer abroad specified in Article 9 of the Law, with your explicit consent.

In addition, if a public authority, person, institution, or organization is authorized to request your personal data under the law, your personal data may be transferred to the authorized person, institution, or organization in accordance with the personal data protection legislation. Requests from judicial authorities will also be met in accordance with the legislation.

4. Your Rights Regarding the Protection of Your Personal Data

We inform you that as a data subject, you have the following rights under Article 11 of the Law:

  • To learn whether your personal data is processed or not,
  • If your personal data has been processed, to request information regarding this,
  • To learn the purpose of processing your personal data and whether it is used in accordance with its purpose,
  • To know the third parties to whom your personal data is transferred domestically or abroad,
  • If your personal data is processed incompletely or inaccurately, to request correction,
  • To request the deletion or destruction of your personal data within the framework of the conditions stipulated in the relevant legislation,
  • To request notification of the correction, deletion, or destruction of your personal data to third parties to whom your personal data has been transferred,
  • To object to the occurrence of a result against you by analyzing the processed data exclusively through automated systems,
  • If you suffer damage due to the unlawful processing of your personal data, to request compensation for the damage.

You have these rights.

5. Application Procedure for Personal Data Owners

As a personal data owner, you can submit your requests regarding your rights listed above to Robokobi in accordance with the application procedures stipulated in Article 13 of the Law and the Communiqué on the Procedures and Principles of Application to the Data Controller (“Communiqué”).

Your request will be concluded by Robokobi as soon as possible and within thirty days at the latest, free of charge; however, if the transaction requires an additional cost, a fee may be charged to you according to the tariff determined by the Personal Data Protection Board.

In this context, you can apply to Robokobi in person, via a notary, registered mail, or registered electronic mail (KEP) by filling out the “KVKK Application Form.”
